Kluaa is an online platform that hosts user-generated and creator-uploaded content. With respect to visual depictions of actual sexually explicit conduct made available on this website, and in reliance on 18 U.S.C. § 2257(c) and 28 C.F.R. § 75.1(c), we are not a "producer" of such depictions but limit our activities to the transmission, storage, retrieval, hosting, or formatting of depictions uploaded by third-party users.
This website is an interactive computer service as defined by 47 U.S.C. § 230(f), and relies on the limited exception to 18 U.S.C. § 2257 record-keeping requirements set forth in 18 U.S.C. § 2257(c) and 28 C.F.R. § 75.1(c) for platforms whose activities are limited to the transmission, storage, retrieval, hosting, or formatting of depictions.
Although we fall within the § 2257(c) exemption, Kluaa voluntarily enforces the following safeguards:
Kluaa has zero tolerance for content depicting minors, non-consensual acts, or any material produced without the documented consent of all participants. Reports of such content are actioned urgently and may be escalated to law enforcement and NCMEC.
To report suspected illegal content or content made without consent, use the in-app report function or contact [email protected]. Valid reports result in prompt removal while an investigation is pending.
Any records required to be maintained pursuant to 18 U.S.C. § 2257 with respect to depictions produced by third-party creators are kept by the respective producers/creators. Custodians of records may be contacted through the creator's published profile contact information.
